Payment of Fees
- A 25% non refundable deposit is required to hold a moorage/storage spot until the commencement of this moorage/storage contract.
- All moorage fees are payable in advance, at the commencement of the moorage contract.
- Storage fees for the term of this storage contract are due and payable upon signing this storage contract or if payable monthly, in advance on the first day of each month.
- Monthly storage payments may be paid by cheque or cash but a credit card is still required to secure the monthly payment. Monthly payments will be processed on that credit card and the date(s) specified, unless customer makes satisfactory arrangements for another method of payment.
- Any unpaid moorage or storage will revert to monthly rates. A 2% per month surcharge is applicable on all over due balances.
- A 5% discount is offered on annual “dry-rack” storage and valet rates if paid in advance.
- Moorage & storage fees include parking for one vehicle.
- Sicamous Marina has no obligation to refund or adjust any prepaid moorage or storage fees should the customer decide to remove its vessel before the duration of the moorage/storage contract has expired.
- Customers who opt for monthly payments agree to pay the entire rate of moorage/ storage regardless of whether they remove their vessel from Sicamous Marina premises, and agree to assume all legal costs incurred to enforce this moorage/storage contract.
- All prices are plus applicable taxes. Sicamous Marina reserves the right to change prices at any time.
- Sicamous Marina reserves the right to cancel, terminate or void this moorage/storage contract at any time.
- Customers assume all charges associated to mechanical/hull repairs & maintenance requested whether in person, in writing, or over the phone. By phoning in to arrange service, repair or maintenance to your craft you agree to incur full costs of the invoice/work order.
- A credit card number on file is required for all house charges (mechanical/body shop invoices & gas shack accounts). Charges which are not paid within 30 days will be automatically paid with the credit card on file. Any unpaid balances will be subject to a 2% per month surcharge.
- A fee of $15.00 per day (plus applicable taxes) will be applied to any watercraft or watercraft accessories (ie trailers) not removed by the end of the contract date specified, unless other arrangements are arranged in writing.
Rules of Use of Marina
- Noise is not permitted on marina property and dock area from 10 p.m. – 7 a.m.
- Children 10 years and under must wear approved life jacket on dock at all times. All children on marina property and dock area must be under adult supervision at all times.
- No running is permitted on marina property and dock area.
- No alcohol or illegal drugs are to be consumed on marina property or dock area.
- Pets must be on leash and owners are responsible to clean up after them.
- Vessels moored or stored at Sicamous Marina shall not be used as year-round living quarters.
- Vessels approaching or leaving the dock area shall do so in a safe and courteous manner.
- Do not cause swells or wake so as to avoid any damaged to other vessels or property.
- Do not store flammable liquids, oily rags, etc aboard your vessel.
- Dispose of all garbage and recyclables properly in containers provided for that purpose.
- Do not dispose of your household garbage in Sicamous Marina containers.
- Customers are required to be off board their vessels when they are being filled with fuel.
- All customers are responsible and liable for safely securing vessels properly in the dock area and for providing adequate bumpers as to protect their own and neighbouring vessels. Sicamous Marina does not check on vessel security and has no responsibility or liability whatsoever in this regard.
- It is the customer’s responsibility to advise Sicamous Marina if any maintenance/service work is required to be done on marina property or dock area.
- Unauthorized vendors are not permitted to perform work on Sicamous Marina premises.
- Transferring of fuel from containers on Sicamous Marina property is strictly prohibited.
Customer Compliance with all Laws
- Insurance on your vessel is required. Proof of insurance must be provided to Sicamous Marina upon request. Sicamous Marina is not responsible or liable for any damage(s) or losses to customer’s vessel or its contents while moored or stored at or on marina property or dock area. Customer to rely upon its own insurance for coverage. SEE LIMITS OF LIABILTY.
- Customer and its invitees shall comply at all times with all municipal, provincial or federal laws applicable to the operation of vessels. The laws of the Province of British Columbia and municipal or federal laws applicable therein apply to this contract.
Limits of Liability
- All customers and invitees enter marina property and dock area at their own risk.
- Customer shall be responsible and liable for any loss, damage(s) or destruction caused to Sicamous Marina’s property, equipment, or any other vessels on marina property or dock area, caused by the customer or the customer’s vessel, whether under operation or care of the moorage customer or other person on board with the customer’s consent. The customer shall render payment for damage done to marina property or dock area, or to other vessels upon invoice for same. CUSTOMER AGREES TO HOLD HARMLESS AND INDEMNIFY SICAMOUS MARINA FROM ANY AND ALL LIABILITY FOR ANY PROPERTY DAMAGE OR PERSONAL INJURY TO CUSTOMER OR ITS INVITEES RESULTING IN ANY WAY FROM THEIR PRESENCE ON MARINA PROPERTY AND/OR THE DOCK AREA.
- SICAMOUS MARINA IS NOT RESPONSIBLE OR LIABLE FOR AND CUSTOMER WAIVES ANY AND ALL CLAIMS FOR:
- a) ANY DAMAGE OR LOSS TO VEHICLES, VESSELS AND/OR TRAILERS, OR ANY CONTENTS THEREOF WHILE PARKED AND/OR STORED ON MARINA PROPERTY OR DOCK AREA:
- b) INJURY TO OR DEATH OF ANY CUSTOMER OR THEIR INVITEES OCCURRING ON OR WITHIN THE MARINA PROPERTY OR DOCK AREA FROM ANY CAUSE WHATSOEVER;
- c) ANY DAMAGE OR LOSS DUE TO ACCIDENT, FIRE, ACTIONS OF WEATHER, ACTIONS OF WATER, ACCUMULATION OF SNOW OR ICE, OR ANY ACT OF GOD OF ANY NATURE WHATSOEVER, OR FOR ANY ACT OF NEGLIGENCE OF SICAMOUS MARINA STAFF, AGENTS, OWNERS, SERVANTS, CUSTOMERS OR INVITEES, OR EMPLOYEES OF ANY THIRD PARTY.
